Indian Constitution Objectives or Proposals

The ideals presented by Nehru in the objective resolution presented to them were included in the objectives of the Constitution. This object, modified by the 42nd Amendment (1976) of the Constitution, is something like this:

"We, the people of India, to make India a complete dominant, socialist, secular, democratic republic and all its citizens:

The main points of the preamble:


(1) The preamble of the Constitution is called 'the key to the Constitution'.

(2) According to the preamble, the center or source of all the powers under the Constitution is 'people of India' only.

(3) The words written in the preamble, i.e.: "We people of India ... accept, enact and energize" this Constitution.

(4) The preamble can not be introduced in the court. This decision was declared in the decision of the Union of India v. Madan Gopal, 1957.

(5) In the Berubadi union dispute (1960), the Supreme Court ruled that, where the language of the Constitution is doubtful, the preamble helps in various elections.

(6) Berubari Later the Supreme Court did not consider the introduction as part of the constitution. Therefore the legislature can not modify the preamble. But the Supreme Court's Keshavanand Bharti v. State of Kerala, in 1973 said that the proposal is part of the constitution. Therefore, the legislature (parliament) can amend it.

(7) Keshavanand Bharati later gave the theory of original concept in the Supreme Court and presented the preamble to the original constitution of the Constitution.

(8) The Parliament can not make a negative amendment in the basic structure of the Constitution, clearly the Parliament can amend that, which extends and strengthens the basic structure,

(9) The words 'socialism', 'secularism' and 'the integrity of the nation' were added in the 42nd Constitution Amendment Act of 1976.
